Some bastard has nicked my pics!

http://search.ebay.co.uk/_W0QQfgtpZ1QQfrppZ25QQsassZhoneymedia

The Hare coursing DVD and Gamekeeping one both have Mollydog on the cover!

This is where he got the originals. I think the licence notes (on what the images can be used for)are fairly clear!

I have contacted Ebay, the web design company/ domain name owners of the image hosting, and the ISP that hosts the server that the pics are on.

Grrrrrrr.

Not good! Hope you manage to get it sorted out.

*hugs*

What lovely pictures! (Which I know is no consolation whatsover.) I hope you get him into trouble.

I'm doing my best...

Quite apart from the insult, it's not even accurate! Foxes and rabbiting? Mollydog thinks foxes and rabbits are incredibly dull. If it's not a squirrel, she really couldn't care less.

What sort of gamekeeper has a greyhound? Gamekeepers have labradors and spaniels, surely! At least, the ones I know do.

Retreievers (labrador or flat-coated, occasionally golden), check.

Spaniels (springer or cocker, occasionally setter), check.

Very occasionally German shepherd, check.

And that's about it.

(I should know - I am the son of a gamekeeper. And yes, I have heard the one about the pheasant plucker's son).

It later occurred to me that as it's a shot of a greyhound in the distance, it could be that she is representing a dog belonging to the Evil Poacher, which the gamekeeper must pursue? Poachers probably don't have greyhounds, but I think they might have lurchers...

Can't think of any other logical reasoning!

[identity profile] wellinghall.livejournal.com 2006-11-10 06:36 pm (UTC)(link)
Lurchers are certainly the archetypal poacher dog, but they'll use anything that can run and retrieve (and, in some cases, bite keepers).

[identity profile] bunn.livejournal.com 2006-11-10 06:42 pm (UTC)(link)
Ah, now the retrieving might be a bit of an issue. And indeed the running, if it needs to be done more than once, for more than about 5 minutes....

Racing greyhounds generally have totally abysmal stamina, though I believe the coursing strains are more robust.

I see the licence does say you may use the image "In printed promotional materials, magazines, newspapers, books, brochures, flyers, CD/DVD covers, etc. "

I know it goes on to say you can't use it for stuff you're selling, but the chap could be acting in good faith - having latched on to the above and not read further.

[identity profile] king-pellinor.livejournal.com 2006-11-10 01:18 pm (UTC)(link)
For example, I went to the licensing link and completely missed your note at the side, which I agree is entirely unambiguous as regards hare coursing.

It does say pretty clearly on the image page itself (under 'restrictions') that "vclare must be notified when using the photo for any public work." - quite apart from my note at the side, which could have been missed, this is a standard feature of the site, and when you search, for example, you can choose to narrow it down to open licence images.

My first message to him did assume it was accidental, none the less, although even if it was accidental, it was still wrong.

However, I am pretty sure that he must have ignored my message, because one of the bidders that I contacted said she had had a second chance offer from him after the winning bidder dropped out. That means he must have logged into Ebay, but has not responded to my message, nor withdrawn the other items he is auctioning using my photos.

Your notes at the side do make it pretty clear. If he wants to use photos then he can either find some which do not have that restriction or take some himself.

How annoying, I hope you get it sorted out quickly.

[identity profile] wellinghall.livejournal.com 2006-11-10 06:28 pm (UTC)(link)
Have you complained directly to the seller?
ext_189645: (Default)

[identity profile] bunn.livejournal.com 2006-11-10 06:33 pm (UTC)(link)
Ooooh yes. Did that first. See comment to king_pellinor - I know he's logged in since, but has not responded.

I'be just sent a rather more stronglyworded email, andI now have the various documents that I need to prove my ownership of the images to a) Ebay and b) the people who own the network on which his server is hosted.

I'm hoping I won't have to use them though.

[identity profile] wellinghall.livejournal.com 2006-11-10 06:34 pm (UTC)(link)
Oh, yes, I see.
